Welcome to Benchmark Body Metrics. By using our services, you acknowledge that you have read, understood, and agree to abide by these Terms & Conditions.

1. Services Provided

Benchmark Body Metrics offers the following services:

• DEXA Scans – Measures bone density and body composition using low-dose X-rays.

• VO₂ Max Testing – Assesses cardiovascular fitness through incremental exercise.

• Resting Metabolic Rate (RMR) Testing – Measures calories burned at rest.

• Blood draws – Clinical blood sampling performed by a certified phlebotomist and processed through a professional diagnostics partner.
• Consultations -- One-on-one health consultations with a registered Functional Nurse Practitioner or MD.

2. Assumption of Risk & Release of Liability

By participating in Benchmark Body Metrics’ services, you acknowledge and accept the inherent risks, including but not limited to:

• DEXA Scan: Exposure to low-dose X-rays (less than a cross-country flight).

• VO₂ Max Test: Strenuous exercise that may cause fatigue, dizziness, shortness of breath, irregular heart rhythms, or, in rare cases, cardiac events.

• RMR Test: Non-invasive test with minimal risks.

• Blood Draw: Minimal risks such as bruising, discomfort, dizziness, or fainting associated with venipuncture.
• Consultations: Educational and informative only; discussion of blood results and health insights with a professional medical provider.

You voluntarily assume all risks and agree that Benchmark Body Metrics, its owners, employees, and affiliates shall not be held liable for any injury, loss, or damages resulting from participation.

Emergency Medical Consent:
In case of a medical emergency, you authorize Benchmark Body Metrics to seek medical assistance on your behalf. You assume all financial responsibility for medical services provided.

3. Participant Acknowledgments

You confirm that:

• You are not pregnant and do not have any medical conditions that would contraindicate participation.
• You are 18 years of age or older, OR you are 14 years of age or older and will have a legal guardian accompany you.

• You have disclosed all relevant medical history.

• You have consulted a physician if you have a history of heart conditions, high blood pressure, respiratory issues, or other medical concerns.

4. Consent for Data & Image Use

By using Benchmark Body Metrics’ services, you grant permission for:

• The collection, processing, and storage of health data for personalized reports.

• The use of anonymous, de-identified data for research or statistical analysis.
• The use of your image or likeness (photos/videos taken in our facility) for marketing, social media, and promotional purposes.
  • If you do not consent to image usage, please notify us in writing before or at your appointment.

5. Privacy & Confidentiality

Benchmark Body Metrics values your privacy.

• Your personal data and test results are stored securely and will not be shared without your explicit consent, except as required by law.

• Email communication is not a fully secure medium, and you acknowledge the risks associated with receiving test results via email.

6. Financial Policy & Payment Terms

• All payments are due at the time of service unless otherwise arranged.

• No refunds will be issued once a test has been performed.
• Cancellations & Rescheduling:
  • Cancellations within 24 hours of an appointment may be subject to a $50 rescheduling fee.
  • No-shows are charged 100% of the appointment fee.

• Benchmark Body Metrics does not process insurance claims. Services may be HSA/FSA eligible, but it is your responsibility to verify reimbursement eligibility. Benchmark can provide itemized receipts for HSA/FSA reimbursement upon request.

7. No Medical Advice or Diagnosis

Benchmark Body Metrics provides health and fitness data and insights, not medical diagnoses or treatment advice.

• Our services are intended for informational and performance-tracking purposes only.

• Any concerns regarding test results should be discussed with a qualified healthcare provider.
• Consultations with our medical professionals are intended to inform and guide health decisions. Should you choose to become a regular patient, the professionals may make suggestions to help improve your health.
• We partner with FIKA Infusion and Wellness for medical consultations and recommendations. Any relationship with their profressionals beyond the initial blood panel consult is between the client and FIKA, not Benchmark Body Metrics.

8. Memberships & Subscriptions

For clients enrolled in membership & subscription plans:

• Membership credits may be shared with others who have permission from the primary account holder.

• Cancellations can be made at any time through the customer portal or by contacting Benchmark staff. Accumulated tests will remain available. We are not able to process refunds.
• We give our best effort to remind you of your test credits and help you hit your goals, but it's your responsibility to get the most out of your credits.

9. Modifications to Terms

Benchmark Body Metrics reserves the right to update these Terms & Conditions at any time. Any modifications will be posted on our website and will take effect immediately upon posting.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Utah, USA. Any disputes will be resolved through binding arbitration in Salt Lake City, UT, waiving the right to a jury trial.

11. Acknowledgment & Agreement

By completing your booking and payment at checkout, you acknowledge that you have read, understood, and agree to these Terms & Conditions. Your continued use of Benchmark Body Metrics services constitutes acceptance of these terms.
